Terms of Service

1. Agreement to Terms

By downloading, installing, or using the BudgetBuddy mobile application (the “App”), you agree to be bound by these Terms of Service (the “Terms”). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you (“User,” “you,” or “your”) and Alper Kaplan (“Developer,” “we,” “us,” or “our”) regarding your use of BudgetBuddy.

Important: This agreement is between you and the Developer only, and not with Apple Inc. (“Apple”). The Developer, not Apple, is solely responsible for the App and its content.

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial use.

Restrictions

You may not:

• Copy, modify, or distribute the App

• Reverse engineer, decompile, or disassemble the App

• Rent, lease, lend, sell, or sublicense the App

• Use the App for any unlawful purpose

• Remove any copyright or proprietary notices

• Use the App to build a competing product or service

• Access the App through any automated means (bots, scrapers)

3. Account Registration

Sign in with Apple

The App requires authentication through Sign in with Apple for full functionality. Authentication is required for:

• Access to subscription features

• CloudKit data synchronization across devices

• Collaborative family budget sharing

• AI-powered insights

Account Responsibilities

If you create an account, you are responsible for:

• Maintaining the confidentiality of your account credentials

• All activities that occur under your account

• Notifying us immediately of any unauthorized access

• Providing accurate and current information

Account Security

We implement security measures including:

• Firebase Authentication with Sign in with Apple

• App Attest hardware attestation for device verification

• Optional Face ID/biometric authentication

However, no system is completely secure. You acknowledge that you provide information at your own risk.

4. Subscription and Payment Terms

Subscription Required

BudgetBuddy requires an active paid subscription to access all App features. Without a subscription, you may only view sample demonstration data to preview the App’s functionality.

Subscription Plans

BudgetBuddy offers the following subscription options:

• Monthly Subscription: Recurring monthly billing with 7-day free trial

• Yearly Subscription: Recurring annual billing with 7-day free trial (best value)

Free Trial

Both subscription plans include a 7-day free trial. During the trial period, you have full access to all App features. You may cancel at any time during the trial period without being charged. If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged.

Demo Mode (Sample Data)

Users without a subscription may explore the App using sample demonstration data. In demo mode:

• You can view pre-populated sample financial data

• You cannot add, edit, or delete any data

• You cannot sync data to the cloud

• You cannot use AI Insights

• Sample data is for demonstration purposes only and resets when you close the App

• Demo mode does not provide any actual financial tracking functionality

Features Included with Subscription

An active subscription provides access to:

• Unlimited wallets and accounts

• Unlimited transaction tracking

• Unlimited budgets and categories

• Unlimited savings goals

• Recurring transaction management

• CloudKit synchronization across devices

• Collaborative family budget sharing

• AI-powered financial insights (50 requests per month)

• Data export to CSV/Excel

• Advanced charts and analytics

• Notifications and reminders

Payment Processing

All payments are processed through Apple’s App Store. By subscribing, you agree to Apple’s terms and conditions for in-app purchases.

Automatic Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

Cancellation

You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial subscription periods.

Refunds

Refund requests must be submitted to Apple directly through the App Store, as we cannot process refunds for in-app purchases. Apple’s refund policies apply.

Price Changes

We reserve the right to change subscription prices. You will be notified of any price changes in advance, and changes will apply to the next billing cycle after notice.

5. Collaborative Family Budget Sharing

Feature Description

BudgetBuddy allows subscribers to collaborate on budgets together through our “Share with Family” feature. This feature enables multiple users to view and contribute to the same budget data in real time.

Subscription Requirement for All Participants

Each participant must have their own active paid subscription to access the collaborative budget features. There is no shared or family subscription plan. If a participant’s subscription expires, they will lose access to the shared budget until they renew their subscription.

How It Works

• Owner: One user creates the shared budget and invites others via a share link

• Participants: Other users accept the invitation to join the shared budget

• Data Sharing: All participants can view and contribute to the same wallets, transactions, budgets, and goals

• Real-Time Sync: Changes made by any participant sync automatically to all other participants

Owner Responsibilities

If you create a shared budget (as the owner), you:

• Control who can access the shared data

• Can remove participants at any time

• Can stop sharing entirely, which removes all participants’ access

• Are responsible for the invitation links you share

Participant Responsibilities

If you join a shared budget (as a participant), you:

• Must have your own active subscription

• Can view and contribute to the shared budget

• Must use the feature responsibly

• Can leave the shared budget at any time

• Will lose access to all shared data if you leave or are removed

Data Behavior

When you join a shared budget as a participant:

• Your existing personal budget data will be cleared

• You will only see the shared budget data from the owner

• If you leave the shared budget, you will start with an empty account

6. User Content and Data

Your Financial Data

You retain ownership of all financial data you enter into the App, including:

• Wallet and account information

• Transaction records

• Budget categories and limits

• Savings goals

• Recurring transaction schedules

Data Accuracy

You are solely responsible for the accuracy of all financial data you enter. The App performs calculations based on the information you provide. We are not responsible for any errors, inaccuracies, or consequences resulting from incorrect data entry.

Data Storage

Your data is stored:

• Locally on your device

• In Apple’s CloudKit (your private iCloud account) when signed in

• Data shared with AI services (with your consent) is processed but not permanently stored by our servers

Data Export

You may export your financial data to CSV format at any time through the App’s settings.

Data Deletion

You may delete your data at any time by:

• Deleting individual transactions, wallets, or goals

• Using the “Delete My Data” option in Settings

• Deleting your account entirely

7. AI-Powered Features — Important Disclaimers

AI Insights Overview

BudgetBuddy offers AI-powered financial insights using Google’s Gemini AI service. These features are:

• Available only to subscribers

• Limited to 50 requests per month

• Subject to your explicit consent

• Require Sign in with Apple authentication

Consent Requirement

Before using AI features, you must provide explicit consent acknowledging that your financial data will be shared with Google’s Gemini AI for processing. You may withdraw consent at any time in Settings.

AI Accuracy Disclaimer

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

1. AI-generated insights may contain errors, inaccuracies, or omissions. Artificial intelligence technology is not perfect and can produce incorrect, misleading, or incomplete results.

2. AI insights are based on pattern recognition and may not accurately reflect your actual financial situation. The AI analyzes your transaction data but cannot understand your complete financial circumstances, goals, or personal situation.

3. We make no representations, warranties, or guarantees regarding the accuracy, reliability, completeness, or timeliness of any AI-generated content. All AI insights are provided “as is” without any warranty.

4. AI recommendations may be inappropriate for your specific circumstances. What works for general patterns may not be suitable for your individual financial needs.

5. You should independently verify all AI-generated information before relying on it. Do not make financial decisions based solely on AI insights without your own research and professional consultation.

6. The AI may fail to identify important financial issues or may identify issues that do not actually exist. False positives and false negatives are possible.

7. AI performance may vary and degrade over time. We do not guarantee consistent results or improvements in AI accuracy.

Data Shared with AI

When you use AI features, the following data is sent to Google Gemini:

• Transaction amounts, categories, and dates

• Wallet balances and types

• Budget information

• Currency preferences

Your email address, name, and device information are not shared with AI services.

AI Data Handling by Google

Per Google’s policies:

• Data is encrypted in transit

• Data may be retained up to 55 days for security monitoring

• Data is not used to train AI models

• Data is not used for advertising

8. Critical Financial Disclaimer

No Financial Advice

BUDGETBUDDY IS NOT A FINANCIAL ADVISOR, INVESTMENT ADVISOR, TAX ADVISOR, OR LEGAL ADVISOR. THE APP DOES NOT PROVIDE PROFESSIONAL FINANCIAL ADVICE OF ANY KIND.

The App is a personal finance tracking tool designed to help you organize your financial information. The App does not provide:

• Professional financial advice or planning

• Investment recommendations or guidance

• Tax advice or tax preparation services

• Legal advice

• Credit counseling or debt management advice

• Insurance advice

• Retirement planning advice

Informational Purposes Only

ALL INFORMATION, CALCULATIONS, INSIGHTS, ANALYSIS, RECOMMENDATIONS, AND SUGGESTIONS PROVIDED BY THE APP, INCLUDING ALL AI-GENERATED CONTENT, ARE FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY.

They should never be relied upon as the basis for any financial decisions. The App is merely a tool to help you track and organize your own financial data.

Consult Professionals

BEFORE MAKING ANY FINANCIAL DECISIONS, YOU SHOULD CONSULT WITH QUALIFIED PROFESSIONALS, including but not limited to:

• Certified Financial Planners (CFP)

• Certified Public Accountants (CPA)

• Licensed Tax Advisors

• Legal Counsel

• Licensed Investment Advisors

• Insurance Professionals

No Guarantees

WE DO NOT GUARANTEE:

• The accuracy, completeness, or reliability of any calculations, projections, or analysis

• Any particular financial outcomes or results

• That using the App or following any suggestions will improve your financial situation

• That the App will identify all relevant financial issues or opportunities

• That budget tracking will lead to savings or financial improvement

• The performance or availability of AI features

Your Sole Responsibility

YOU ARE SOLELY AND ENTIRELY RESPONSIBLE FOR:

• All financial decisions you make, regardless of whether you used the App

• Verifying the accuracy of all calculations and data in the App

• Seeking appropriate professional advice for your specific situation

• Understanding the limitations of the App and AI features

• Any consequences of your financial decisions

• Your own financial well-being and outcomes

9. Limitation of Liability

Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF:

• MERCHANTABILITY

• FITNESS FOR A PARTICULAR PURPOSE

• NON-INFRINGEMENT

• ACCURACY

• COMPLETENESS

• RELIABILITY

• AVAILABILITY

WE SPECIFICALLY DISCLAIM ANY WARRANTY THAT THE APP WILL MEET YOUR REQUIREMENTS OR THAT THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

Assumption of Risk

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE APP IS AT YOUR SOLE RISK. You are solely responsible for any damage to your device, loss of data, or other harm that results from your use of the App.

Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES

• LOSS OF PROFITS, REVENUE, BUSINESS, SAVINGS, OR GOODWILL

• LOSS OF DATA OR DATA CORRUPTION

• FINANCIAL LOSSES OF ANY KIND

• EMOTIONAL DISTRESS OR MENTAL ANGUISH

• DAMAGES RESULTING FROM YOUR FINANCIAL DECISIONS

• DAMAGES RESULTING FROM AI ERRORS, INACCURACIES, OR OMISSIONS

• DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO YOUR DATA

• DAMAGES RESULTING FROM INTERRUPTION OR UNAVAILABILITY OF SERVICE

• DAMAGES RESULTING FROM BUGS, VIRUSES, OR OTHER HARMFUL COMPONENTS

• DAMAGES RESULTING FROM THIRD-PARTY ACTIONS OR SERVICES

THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Maximum Liability Cap

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP EXCEED THE GREATER OF:

• The amount you paid for the App or subscription in the twelve (12) months immediately preceding the claim, OR

• Fifty United States Dollars ($50 USD)

Essential Purpose

THESE LIMITATIONS SHALL APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of certain warranties or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by applicable law. The limitations in this section shall apply to the fullest extent permitted by law in the applicable jurisdiction.

10. Indemnification

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS THE DEVELOPER, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, LOSSES, LIABILITIES, COSTS, AND EXPENSES (INCLUDING REASONABLE ATTORNEY’S FEES) ARISING FROM OR RELATED TO:

• Your use or misuse of the App

• Your violation of these Terms

• Your violation of any applicable law or regulation

• Your violation of any third-party rights

• Your financial decisions, regardless of whether they were influenced by the App

• Any content or data you submit through the App

• Your use of AI features and any reliance on AI-generated content

• Your participation in collaborative family budget sharing

• Any dispute between you and other users of collaborative features

11. Intellectual Property

Our Intellectual Property

The App, including its design, features, graphics, logos, icons, and content, is owned by the Developer and protected by intellectual property laws. You may not use our intellectual property without written permission.

Feedback

If you provide feedback, suggestions, or ideas about the App, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, modify, and incorporate such feedback without any obligation or compensation to you.

12. Third-Party Services

Services Used

The App integrates with the following third-party services:

• Apple CloudKit: Data synchronization

• Apple Sign in with Apple: Authentication

• Firebase Authentication: User management

• Firebase App Check: Security verification

• Google Gemini AI: AI-powered insights (with consent)

Third-Party Terms

Your use of third-party services is subject to their respective terms and privacy policies. We are not responsible for third-party services, their availability, or their performance.

Third-Party Compliance

You agree to comply with all applicable third-party terms when using the App.

13. Termination

Termination by You

You may stop using the App at any time. To fully terminate:

• Delete the App from your device

• Cancel any active subscriptions through Apple ID settings

• Delete your account through Settings (if applicable)

Termination by Us

We may suspend or terminate your access to the App at any time, without notice or liability, for:

• Violation of these Terms

• Fraudulent, illegal, or abusive activity

• Non-payment or payment disputes

• Extended periods of inactivity

• Any other reason at our sole discretion

Effect of Termination

Upon termination:

• Your license to use the App ends immediately

• You lose access to all features

• Your locally stored data remains on your device

• CloudKit data remains in your iCloud account

• No refunds for unused subscription periods

• We have no obligation to maintain or provide your data

Survival

The following sections survive termination: Intellectual Property, Limitation of Liability, Indemnification, Dispute Resolution, and General Provisions.

14. Apple-Specific Terms

Acknowledgement

You acknowledge that these Terms are between you and the Developer only, not with Apple, and the Developer is solely responsible for the App and its content.

Scope of License

The license granted to you is limited to a non-transferable license to use the App on Apple-branded products that you own or control, as permitted by the App Store Terms of Service.

Maintenance and Support

The Developer is solely responsible for providing any maintenance and support services for the App. Apple has no obligation to furnish any maintenance and support services.

Warranty

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.

Product Claims

The Developer, not Apple, is responsible for addressing any claims relating to the App, including:

• Product liability claims

• Claims that the App fails to conform to legal requirements

• Claims arising under consumer protection or similar legislation

Intellectual Property Claims

The Developer, not Apple, is responsible for the investigation, defense, settlement, and discharge of any third-party intellectual property infringement claims.

Legal Compliance

You represent and warrant that:

• You are not located in a country subject to U.S. Government embargo

• You are not listed on any U.S. Government prohibited or restricted parties list

Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Posting updated Terms in the App

• Updating the “Last Updated” date

• Sending a notification for significant changes

Your continued use of the App after changes constitutes acceptance of the modified Terms. If you do not agree to modified Terms, you must stop using the App immediately.

16. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Developer regarding the App and supersede all prior agreements and understandings.

Severability

If any provision of these Terms is found unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce it later or to enforce any other provision.

Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.

Notices

We may provide notices through the App, email, or other reasonable means. You are responsible for keeping your contact information current.

No Agency

Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and the Developer.

Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
